Contested or uncontested divorce: which is yours?
A divorce is uncontested when spouses have already agreed on every issue, so there is nothing left to negotiate or for the court to decide. A divorce is contested when spouses have not agreed on all issues before filing.
Why it matters for cost
At the ALC, uncontested matters are handled for a flat fee: $2,000–$3,000 without children and $3,000–$5,000 with minor children. That covers document preparation, two revisions to the settlement agreement (plus two to the Parenting Plan when there are children), filing and the final hearing. The court’s filing fee is separate.
Contested cases are billed hourly with a retainer, because the work depends on what still has to be resolved.
Not sure which applies?
That is exactly what the free 20-minute consultation is for.
